By creating an account, clicking "I agree", or using the UpQuest app or website, you accept these Terms and our Privacy Policy. If you do not agree, do not use UpQuest.

1. Eligibility

UpQuest is intended only for users 18 years and older. By using it you represent that you are at least 18 and legally able to enter into these Terms.

2. What UpQuest Is

UpQuest is an AI-powered health and fitness coaching service. It generates personalized plans, analyzes information you provide, and answers questions through an AI coach. It is a general wellness and informational tool only.

3. Not Medical Advice

UpQuest provides general health and wellness information for educational purposes only. The AI coach, plans, supplement suggestions, and bloodwork insights are NOT medical advice and NOT a substitute for professional diagnosis or treatment. AI output can be incomplete or incorrect — always review it with a qualified healthcare provider before acting, especially regarding medications, hormones, or any prescription or controlled substance. You are solely responsible for decisions you make based on UpQuest.

4. Proper Use of the AI Coach

Use it in good faith and only as intended:

• For your own personal, lawful health and fitness goals
• Provide accurate information
• Independently review AI output before relying on it
• Treat it as guidance, not a licensed professional

5. Acceptable Use & Prohibited Conduct

To keep UpQuest available and affordable for everyone, you agree NOT to:

• Abuse, overload, or attempt to drain the AI coach, its compute, or its token/usage capacity — including excessive, automated, scripted, bulk, or programmatic requests
• Use bots, scrapers, or any automated means to access the service or generate volume beyond normal personal use
• Attempt to "jailbreak", prompt-inject, or otherwise manipulate the AI into bypassing its safety, content, or usage rules
• Circumvent, reset, or evade rate limits, free-trial limits, the paywall, or subscription requirements (including via reinstalling, multiple accounts, or shared or forged purchase receipts)
• Reverse-engineer, copy, resell, or redistribute the service, its AI outputs, or its underlying models
• Use UpQuest unlawfully, to harm others, or to generate prohibited or abusive content
• Interfere with, probe, or attempt to breach the security or integrity of the service or its infrastructure

6. Fair Use & Rate Limits

AI requests consume real computing resources that cost money to run. Your use is subject to reasonable rate limits and fair-use thresholds, which we may set, change, or enforce at our discretion. Abnormal, excessive, or automated usage that drains resources may be throttled, suspended, or blocked without notice.

7. Suspension & Termination — No Refund

We may suspend, restrict, ban, or permanently terminate your account and access at our sole discretion, with or without notice, if we reasonably believe you violated these Terms — including the acceptable-use and anti-abuse rules, or any attempt to drain, abuse, or exploit the AI or token usage. If your account is suspended or terminated for a violation, you are NOT entitled to any refund of fees already paid, and any remaining subscription time may be forfeited, to the fullest extent permitted by law.

8. Subscriptions, Billing & Refunds

• Auto-renewing subscriptions are billed through the Apple App Store or our website checkout
• Subscriptions renew automatically unless cancelled before the end of the current period. App Store subscriptions are managed in Apple ID settings; website subscriptions through the billing portal
• Except where required by law (or via the platform's own refund process), payments are non-refundable, including for partially used periods
• A free trial, if offered, converts to a paid subscription unless cancelled before it ends

9. Your Content & Data

You retain ownership of the information you submit. You grant us a limited license to process it to operate the service (e.g., sending it to our AI provider to generate your plan). See our Privacy Policy for details.

10. Intellectual Property

The UpQuest app, website, branding, and software are owned by us and protected by law. These Terms grant you a personal, non-transferable, revocable license to use UpQuest for its intended purpose only.

11. Disclaimers & Limitation of Liability

The service is provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for decisions you make based on AI output. Our total liability is limited to the amount you paid us in the 12 months before the claim.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes in-app, on the website, or by notification. Continued use after changes take effect constitutes acceptance.
